Can and/or should I claim from my insurance for the destruction of my moped?

My moped was seized and taken to Perivale Pound where it was subsequently destroyed. It was taken because they mistakenly thought I needed a more recent CBT certificate. I have comprehensive insurance to cover me for my moped. My broker told me I could not claim from this policy as it was seized legally even if this was wrongly done.
